Public Offer Agreement

Individual entrepreneur Zaiets Dmytro Anatoliiovych (the “Provider”), acting under Articles 633, 641, 642 of the Civil Code of Ukraine, offers any legally capable individual (the “User”) to enter into this Public Offer Agreement (the “Agreement”) on the terms below.

1. General provisions

1.1. This Agreement is a public offer. Full and unconditional acceptance of it is the User’s registration in the Service and/or payment for the services.

1.2. By accepting this Agreement, the User confirms they have read and agree with it, as well as with the Privacy Policy and Terms of Use.

2. Definitions

2.1. The “Vitals” Service — an informational online service (the website vitals-analysis.com and a mobile application) that lets the User upload, store, organize and track their own lab test results.

2.2. Subscription — paid access to the Service’s advanced features for the chosen period.

3. Subject of the Agreement

3.1. The Provider grants the User access to the “Vitals” Service and its features under the chosen plan, and the User undertakes to pay for such services per the chosen plan.

3.2. The Service is purely informational, is not a medical service, does not provide medical advice, diagnosis or treatment, and is not a medical device. “In-range / out-of-range” indicators are based on the reference values in the User’s documents and are for information only.

4. Pricing and payment

4.1. The following plans apply:

Free — UAH 0 (basic features);
Plus — UAH 199/month or UAH 1990/year;
Family — UAH 349/month or UAH 3490/year.

4.2. Payment is made in hryvnia by bank card via the LiqPay payment service. The Provider does not store or have access to the User’s card data.

4.3. The subscription is auto-renewable: after the paid period ends, the next period’s price is charged until the User cancels.

4.4. Current prices are shown in the Service. The Provider may change prices; a change does not affect an already paid period.

5. Cancellation and refunds

5.1. The User may cancel auto-renewal at any time in the Service settings. Cancellation stops further charges; an already paid period runs until it ends.

5.2. As the service is digital and provided immediately after payment, funds for an already provided (used) period are not refunded, except as required by the laws of Ukraine.

6. Rights and obligations

6.1. The Provider undertakes to grant access to the Service under the chosen plan and to keep it operational.

6.2. The User undertakes to provide accurate data, use the Service per the Terms of Use and not infringe third-party rights.

6.3. The Provider may suspend access if the User breaches this Agreement.

7. Confidentiality

7.1. Personal data is processed under the Privacy Policy and the Law of Ukraine “On Personal Data Protection”. The User’s data belongs to them; they may export or delete it at any time.

8. Liability

8.1. The Service is provided “as is”. The Provider is not liable for decisions the User makes based on information from the Service. For health matters, the User should consult a qualified doctor.

9. Term and changes

9.1. The Agreement is effective from acceptance until the User stops using the Service.

9.2. The Provider may amend this offer by publishing a new revision in the Service. Continued use means agreement with the new revision.
